The precarious rights of senior citizens, especially those who are highly educated and who are expected to counsel and guide the younger generations, has stimulated the creation internationally of advocacy associations and opinion leader groups. The strength of these groups, however, varies from country to country. In some countries, they are supported and are the focus of intense interest; in others, they are practically ignored. For this is reason we believe that the creation of a network of all these associations (...) is essential. The proposed network would act as a support for the already-existing policies of the United Nations’ High Commission for Human Rights, of independent experts, and of the Global Alliance for the Rights of Older People. All three have long ago recommended the creation of a recognized instrument for uniting presently scattered efforts. The proposed network, therefore, will seek to promote the international exchange of relevant expertise, and it will reinforce the commitments and actions that single countries are currently taking to meet these objectives. For example, informative public events can be organised to promote particular support initiatives and to provide an opportunity for new members of the network to be presented. The network will promote health for senior citizens, disease prevention, senior mobility, safe free time for seniors, alimentary education, protection against new risks and dangers, as well as equity in the services necessary for seniors to adopt new information and communication technologies. In the case of retired academic members, the network will promote equality with respect to continuing use of digital technologies (particularly email), continuing access to research libraries, and the guaranteed ability for seniors to fund their own research programs and to deliver free seminars. Despite the fact that common sense taxes emotions with irrationality, philosophers have, by and large, celebrated their functionality. They are credited with motivating, steadying, shaping or harmonizing our dispositions to act, and with policing norms of social behaviour. It's time to restore emotion's bad rep. To this end, I shall argue that we should expect that some of the “norms” enforced by emotions will be unevenly distributed among the members of our species, and may be dysfunctional at the individual, social, (...) moral, or even species levels. I”ll adduce three considerations in support of that pessimistic view: The fallacy of adaptive fixation, the moral randomness of group selection, and the lack of fit between “natural norms” set up by evolution and those moral and social norms we would like philosophy to justify. Richard Moran has argued, convincingly, in favour of the idea that there must be more than one path to access our own mental contents. The existence of those routes, one first-personal—through avowal—the other third-personal—no different to the one used to ascribe mental states to other people and to interpret their actions—is intimately connected to our capacity to respond to norms. Moran’s account allows for conflicts between first personal and third personal authorities over my own beliefs; this enable some instances of (...) Moore-paradoxical cases to be meaningful. In this paper we reflect on the consequences of this view for the acquisition of beliefs, and argue that, as in the moral case, excessive concentration on a thirdpersonal understanding of thought undermines the very idea of being directed to the world and of being capable to fully own our own beliefs. We suggest that maybe too much attention to epistemic virtues or tojustification is misdirected and could produce beliefs that are themself not first-personal enough. (shrink)

It is common to criticize the idea of objectivity by claiming that we cannot make sense of any cognitive contact with the world that is not constituted by the very materials of our thinking, and to conclude that the idea must be abandoned and that the world is ‘well lost’. We resist this conclusion and argue for a notion of objectivity that places its source within the domain of thoughts by proposing a conception of facts, akin to McDowell’s, as thinkable (...) while independent of any act of thinking. This paper argues that the normative character of our unreflective situated behaviour is not factual. We highlight a problematic assumption shared by the two most influential trends in contemporary philosophy of cognitive science, reductionism and enactivism. Our intentional, normative explanations are referential, descriptive or factual. Underneath this assumption lies the idea that only facts can make true or false our attributions of cognitive, mental and agential abilities. We will argue against this view by describing the main features and problems of (...) reductionism and enactivism and then we will offer two arguments against this shared factualist assumption: (1) normative vocabulary is ineliminable if we want a complete explanation of our situated practices; and (2) the factualist assumption is a species of the is-ought fallacy. Finally, we will claim that a folk psychological explanation of our normative practices is fully compatible with ontological naturalism when such descriptivist or factualist assumption is rejected. In this paper, we offer a criticism, inspired by Wittgenstein’s rule-following considerations, of the enactivist account of perception and action. We start by setting up a non-descriptivist naturalism regarding the mind and continue by defining enactivism and exploring its more attractive theoretical features. We then proceed to analyse its proposal to understand normativity non-socially. We argue that such a thesis is ultimately committed to the problematic idea that normative practices can be understood as private and factual. Finally, we offer a (...) characterization of normativity as an essentially social phenomenon and apply our criticisms to other approaches that share commitments with enactivism. (shrink)

In this paper we challenge the notion of ‘normativity’ used by some enactive approaches to cognition. We define some varieties of enactivism and their assumptions and make explicit the reasoning behind the co-emergence of individuality and normativity. Then we argue that appealing to dispositions for explaining some living processes can be more illuminating than claiming that all such processes are normative. For this purpose, we will present some considerations, inspired by Wittgenstein, regarding norm-establishing and norm-following and show that attributions of (...) normativity to non-social agents are deeply paradoxical. The main conclusions of our discussion are: (1) circular and internal explanations centred on the stability of living systems are insufficient to account for processes where the environment plays an important role, such as adaptation. Enactivism is not an explanatory alternative to evolutionary biology but needs it as a complement to accounts focused on the internal self-assembly of organisms; (2) though we share enactivism’s anti-representational spirit, we argue that ecological psychology can offer a better account of perception. Este artigo tem por objetivo descrever e comparar as propostas da política de reconhecimento desenvolvidas por Axel Honneth, na obra Luta por reconhecimento, e por Charles Taylor, na obra Argumentos filosóficos. Ambos os pensadores buscam em Hegel uma referência teórica para renovar suas teorias. Em Honneth, a noção de reconhecimento está fortemente ancorada na intersubjetividade dos indivíduos, decorrente de uma luta por reconhecimento: o desrespeito a qualquer uma das formas de reconhecimento pleno – o amor, o direito e a solidariedade (...) – gera demandas sociais de reconhecimento e, consequentemente, a luta pelo mesmo. Em Taylor, o reconhecimento pressupõe uma noção ontológica de bem, prefigurado na linguagem, tradição, valores e costumes. Ambos os autores mantêm um vínculo forte com a ideia hegeliana da intersubjetividade como instância fundamental na formação das identidades, enquanto base coletiva dos movimentos sociais. (shrink)

McDowell’s minimal empiricism holds that experience, understood as providing conceptually articulated contents, plays a role in the justification of our beliefs. We question this idea by contrasting the role of perceptual experience in moral and non-moral judgments and conclude that experience per se is irrelevant in the former case and should also be so in the latter one: only with the help of adequate beliefs experience can provide a connection with the world. To this end, I look to perceptions for a model of non-propositional states that might be true or false, and to desires for a model of propositional attitudes the norm of which is other than the semantic satisfaction of their propositional object. Those models inspire a conception of generic truth, which can admit of degrees for analogue representations such as emotions; (...) belief-like states, by contrast, are digital representations. Emotional truth is a dubious though attractive notion, but emotional accuracy is much easier to make sense of. My approach to accuracy goes via an account of what makes a story accurate. Stories can be accurate but not true, and emotions can be accurate whether or not they are true. The capacity for emotional accuracy, for emotions that fit a person's situation, is an aspect of emotional intelligence, which is as important an aspect of rational human agency as the intelligent formation of beliefs and desires. nos últimos anos, John McDowell tem proposto uma concepção de filosofia em que o objetivo da disciplina não é oferecer teses substanciais, mas antes revelar modos de pensar e premissas ocultas que estão na base da filosofia construtiva. Esta visão terapêutica tem sido chamada ‘quietismo’ e deve muito a algumas idéias favoritas de Wittgenstein ao longo de toda a sua vida. No entanto, a obra de Wittgenstein (e, talvez, também a de McDowell) parece oscilar entre duas compreensões de quietismo: pode-se (...) ser quietista por não macular aquilo que é mais importante com discussões explícitas ou pode-se ser quietista por não ter nada a dizer. Argumentaremos que o segundo tipo do quietismo não implica recusar em se ocupar com a filosofia do passado, nem tampouco adotar uma atitude contemplativa. A concentração sobre o particular, em ética tanto quanto em qualquer outra área da filosofia, é suficiente para minar as ambições universalistas da filosofia tradicional e descortinar um aumento na ação filosófica. O objetivo precípuo da nossa pesquisa consiste em analisar a correlação da luta por reconhecimento, Comissão Nacional da Verdade – CNV (2012 - 2014) e memória coletiva. Para alcançar o nosso objetivo, nos propomos à análise da memória a partir das lutas coletivas e sociais evocando a memória coletiva no âmbito de uma relação intersubjetiva que envolve disputas, negociações manipulações e esquecimento. É importante frisar que o quadro teórico de nosso trabalho está amparado no debate em torno das lutas por (...) reconhecimento. Para tanto, verificaremos a partir de Axel Honneth, a gramática moral das lutas em torno desse reconhecimento recíproco e como acontece essa dinâmica nas práticas sociais vigentes e, ipso facto pretendemos articular a discussão do paradigma da comunicação com a memória coletiva. The main aim of this article is to reflect on the impact of biases related to artificial intelligence (AI) systems developed to tackle issues arising from the COVID-19 pandemic, with special focus on those developed for triage and risk prediction. A secondary aim is to review assessment tools that have been developed to prevent biases in AI systems. In addition, we provide a conceptual clarification for some terms related to biases in this particular context. We focus mainly on nonracial biases (...) that may be less considered when addressing biases in AI systems in the existing literature. In the manuscript, we found that the existence of bias in AI systems used for COVID-19 can result in algorithmic justice and that the legal frameworks and strategies developed to prevent the apparition of bias have failed to adequately consider social determinants of health. Finally, we make some recommendations on how to include more diverse professional profiles in order to develop AI systems that increase the epistemic diversity needed to tackle AI biases during the COVID-19 pandemic and beyond. Departing from basic concepts in abstract logics, this paper introduces two concepts: conjunctive and disjunctive limits. These notions are used to formalize levels of modal operators.

This article introduces some concepts that help exploring the ontological import of universal logic. It studies the notions of an antilogic and counterlogic associated to each logic and shows some of their properties. It presents the notion of galaxy, as the class of possible worlds compatible with a given logic.We explore some consequences of these developments.

A importância está em percebermos aonde está este objeto, o que ele significa, qual é a sua dignidade e o seu valor ôntico. The aim of this paper is to show the relevance of paragraph 308 of "On Certainty" to consider a wittgensteinian contribution to the epistemological thought. Given that Wittgenstein's concerns turn, in "On Certainty", to major epistemological problems - namely, the problem of doubt, certainty, knowledge and justification - I set forth some relevant results of his "visit" to Epistemology through the exegesis of paragraph 308, which sistematize the problems faced throughout the book. By doing so, three main themes of Wittgenstein's (...) Epistemology are explored: the categorical distinction between "knowledge" and "certainty", the logical role of "doubt" and the grammatical role of some empirical propositions. (shrink)

Resumo: Sabe-se que a pecuária é uma parcela do agronegócio que move a economia do país, e incluso está a produção leiteira, que tem, a cada ano seu desenvolvimento elevado, de forma em que é priorizado a eficiência no aumento de sua produção, com o objetivo de suprir a demanda, e a maior rentabilidade do produtor. Diante disso, medidas de manejo reprodutivo e alimentar são adotadas, sendo estas capazes de elevar a produtividade com o menor custo possível. O trabalho objetivou (...) pautar acerca do conhecimento sobre o manejo nutricional correto e escore corporal, que afetam diretamente a produtividade do animal, o conhecimento acerca do ciclo reprodutivo de vacas, expondo a detecção de estro, bem como metodologias eficazes aplicadas na reprodução, e práticas de bem estar, que, quando ausente, é apontado como um dos precursores da ineficiência reprodutiva. Abstract: It is known that livestock is a part of agribusiness that drives the country's economy, and is even milk production, which has, every year, its high development, so that it is prioritizing efficiency in increasing its production, with the objective of supplying the demand, and the greater producer profitability. Therefore, reproductive and food management measures are adopted, being able to increase productivity with the lowest possible cost. The work aimed guide about knowledge about correct nutritional management and body score, which affect directly the animal's productivity, knowledge about the reproductive cycle of cows, exposing estrus detection, as well as effective methodologies applied in reproduction, and practices of well-being, which, when absent, is pointed out as one of the precursors of inefficiency reproductive. Schaffer (2010) argues that the internal relatedness of all things, no matter how it is conceived, entails priority monism. He claims that a sufficiently pervasive internal relation among objects implies the priority of the whole, understood as a concrete object. This paper shows that at least in the case of an internal relatedness of all things conceived in terms of physical intentionality - one way to understand dispositions - priority monism not only doesn't follow but also is precluded. We conclude (...) that the internal relatedness of all things is compatible with several different ontologies (including varieties of pluralism) but entails nothing concerning dependence between concrete objects. Nossa pesquisa é pautada na tentativa de compreender alguns conceitos da filosofia aristotélica, mais especificamente as noções de forma, matéria, privação e potência, e um pouco sobre a metodologia usada pelo filósofo. As linhas abaixo compõem um capítulo da minha monografia de fim de curso, intitulada Dialogo com a tradição: A conquista de novas convicções acerca dos princípios de natureza no primeiro livro da Física aristotélica, realizada na Universidade Federal Rural do Rio de Janeiro. Nela tratei a respeito da metodologia (...) de Aristóteles que, dentre outras coisas, passa pela crítica à filosofia precedente, esclarecendo assim algumas questões do primeiro livro da Física – livro no qual o filósofo tenta determinar quantos e quais são os princípios da natureza. We present a module based criterion, i.e. a sufficient condition based on the absolute value of the matrix coefficients, for the convergence of Gauss–Seidel method (GSM) for a square system of linear algebraic equations, the Generalized Line Criterion (GLC). We prove GLC to be the “most general” module based criterion and derive, as GLC corollaries, some previously know and also some new criteria for GSM convergence. Although far more general than the previously known results, the proof of GLC is simpler. (...) O ficcionalismo, geralmente classificado como um tipo de nominalismo, apresenta como perspectiva precípua a tese de que os entes matemáticos são ficções. Para o ficcionalista, o discurso matemático é desprovido de conteúdo. Hartry Field, que é o principal defensor dessa concepção ontológica da matemática, contesta, em Science Without Numbers, a utilização de entes matemáticos na redação de teorias da física, alegando que a defesa mais plausível do realismo ontológico matemático é o argumento da indispensabilidade de Quine-Putnam. O ficcionalismo defendido por (...) Field nos permite, de acordo com Shapiro, classificá-lo no grupo filosofia-primeiro, ou seja, entre os filósofos que defendem que a filosofia deve ser responsável por legislar a respeito da prática matemática. Dessa forma, podemos considerar Field um revisionista epistemológico. Como se sabe, a dependência da ciência moderna em relação ao discurso matemático coloca a tese ficcionalista em xeque. Ainda assim, se partirmos dos pressupostos filosóficos da vertente formalista da filosofia da matemática, que concebe a matemática como constituída de um conjunto de regras sem significado que podem ser manipuladas de maneira puramente sintática, poderemos traçar importantes analogias entre matemática e ficção, tal como também entre metamatemática e metaficção. Para um formalista simpático à tese ficcionalista, o estatuto ontológico da matemática é semelhante ao das regras de um jogo de xadrez. (shrink)

>e paper studies the discussion about human good in Eudemian Ethics I.7. It is particularly concerned with the existence, in the text, of two characteristics of the human good: its peculiarity, on the one hand, which consists not only in the quali- (cation ‘human’ (anthropinon), but also in the assignment of this good to the domain of action (the activity that distinguishes humans from other beings), and, on the other hand, the fact that it belongs to a spectrum containing the (...) goods of other beings, like god and the remaining living beings. Divinity works as the standard for the distinction between eudaimonic goods – belonging to beings whose nature implies participation in the divine (humans, for example) – and non-eudaimonic goods that belong to those beings deprived of such participation. Resorting to other passages from the Eudemian Ethics, as well as other texts from the corpus, the paper defends that the two characteristics of the human good presented in EE I.7 foreshadow an important di?erence between the two Aristotelian treatises on eudaimonia: whereas the Nicomachean Ethics emphasizes contemplation as the activity through which humans participate in the divine, the Eudemian Ethics stresses virtuous actions as a human activity related to the divine. El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios desacuerdos acerca (...) de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. At last, I will justify the main elements of the poena naturalis by their best moral light. (shrink)

Assessment of marine debris ingestion by sea turtles is important, especially to ensure their survival. From January to December 2011, 23 specimens of five species of sea turtleswere found dead or dying after being rehabilitated, along the coast of the municipality of Rio de Janeiro, Brazil. To detect the presence of marine debris in the digestive tract of these turtles, we conducted a postmortemexamination from the esophagus until the distal portion of the large intestine for each specimen. Of the total (...) number of turtles, 39% had ingested marine debris such as soft plastic, hard plastic, metal, polyethylene terephthalate (PET) bottle caps, human hair, tampons, and latex condoms. Five of the seven sea turtles species are found along the Brazilian coast, where they feed and breed. A large number of animals are exposed to various kinds of threats, including debris ingestion. La mal llamada “Conquista del Desierto” constituyó una serie de campañas militares ocurridas en el actual territorio patagónico argentino entre los años 1878 y 1885 cuyo resultado fue el asesinato, la violación y sometimiento a la esclavitud de diversos pueblos y comunidades indígenas. Este no fue un caso aislado, sino que se suma a una serie de ataques sistemáticos que han sufrido los indígenas en la Argentina. En los últimos años, a raíz del reclamo y las luchas de los pueblos (...) y comunidades indígenas, así como también de las organizaciones de derechos humanos, se han comenzado a juzgar algunos de estos hechos. En particular, la Masacre de Napalpí (1924) y la Masacre de La Bomba (1947) fueron los primeros que lograron respuestas judiciales favorables. En ambos se determinó que el accionar estatal era constitutivo de un genocidio y, por lo tanto, se debía resarcir a las comunidades actuales. Ahora bien, la Campaña del Desierto, al día de hoy, no tiene respuesta por parte del Estado. Teniendo presente este panorama, nuestro objetivo en este trabajo es reconstruir los diferentes problemas que enfrenta la posibilidad del reclamo judicial. Para ello, comenzaremos describiendo en qué consistió la Campaña del Desierto. Luego, explicaremos la noción de genocidio aplicado a hechos de injusticias históricas. Como tercer paso, reconstruiremos los casos jurisprudenciales que se han preocupado por genocidios indígenas ocurridos en el pasado. Con este panorama revelado, nos enfocaremos en los diferentes problemas jurídicos y políticos que surgen en los reclamos de justicia. (shrink)

Reconstruiremos un pasaje puntual de GC 2. 10 para defender la hipótesis del uso real de la demostración científica en los tratados científicos. Die Forschung hat bislang entweder bemängelt, dass Nietzsches Philosophie ein Begriff von szialer Gerechtigkeit fehlt oder had einen solchen kaum in den Blick bekommen. Im Gegensatz dazu argumentiert der Aufsatz dafür, dass der sozialen Gerechtigkeit in Nietzsches politischem Denken eine zentrale Rolle zukommt. The main thesis of the essay is that this conception is embodied in Nietzsche's notion of a well-ordered state or society. An additional thesis concerns the anthropological basis of what Nietzsche holds to be a just social order. La premisa que guía nuestra investigación es que Poética es un tratado científico, i. e., que la investigación desarrollada en dicha obra se corresponde con el examen de una téchne. Defendemos que el método utilizado se corresponde con el método general de investigación denominado “salvar las apariencias”. Tal método es expuesto con más detalle en otras obras del corpus pero lo presuponemos utilizado en Poética. Si bien el método presupone la recolección de datos, no se limita a eso puesto que (...) el paso ulterior consiste en la caracterización de las diferencias y la exposición de las cuatro causas del fenómeno. The translational research community, in general, and the Clinical and Translational Science Awards (CTSA) community, in particular, share the vision of repurposing EHRs for research that will improve the quality of clinical practice. Many members of these communities are also aware that electronic health records (EHRs) suffer limitations of data becoming poorly structured, biased, and unusable out of original context. This creates obstacles to the continuity of care, utility, quality improvement, and translational research. Analogous limitations to sharing objective data in (...) other areas of the natural sciences have been successfully overcome by developing and using common ontologies. This White Paper presents the authors’ rationale for the use of ontologies with computable semantics for the improvement of clinical data quality and EHR usability formulated for researchers with a stake in clinical and translational science and who are advocates for the use of information technology in medicine but at the same time are concerned by current major shortfalls. This White Paper outlines pitfalls, opportunities, and solutions and recommends increased investment in research and development of ontologies with computable semantics for a new generation of EHRs. "A theoretical juice extractor: The role of mathematics in scientific explanation". There have recently been proposed cases where, supposedly, mathematics would play a genuinely explanatory role in science. These have been divided into those situations where the explanatory role would be played by mathematical operations, and those where it would be played by mathematical entities. In this article, I analyze some of these purported cases and argue that claims that mathematics can be genuinely explanatory are unfounded. Throughout my discussion, I (...) emphasize the representational role of mathematics, as opposed to its supposed explanatory role: the role of mathematics, even in the cases that I discuss, is to represent physical facts and help draw inferences about those facts. En la literatura jurídico penal, el arrepentimiento cobra relevancia en un lugar específico: la condena, más precisamente, en la determinación de la pena del sujeto que ha sido encontrado responsable por la comisión de un delito y que, a su vez, se encuentra arrepentido por su accionar. Desde la concepción comunicativa del castigo, en este trabajo contestaré las siguientes preguntas: ¿El arrepentimiento significa un menor reproche penal o es indiferente para la determinación de la pena? en caso de que implique (...) un acercamiento al castigo mínimo establecido en la legislación ¿Cuándo es razonable que esto suceda? “Structuralism, Fictionalism, and the Applicability of Mathematics in Science”. This article has two objectives. The first one is to review some of the most important questions in the contemporary philosophy of mathematics: What is the nature of mathematical objects? How do we acquire knowledge about these objects? Should mathematical statements be interpreted differently than ordinary ones? And, finally, how can we explain the applicability of mathematics in science? The debate that guides these reflections is the one between mathematical realism and (...) anti-realism. On the other hand, the second objective is to discuss the arguments that use the applicability of mathematics in science to justify mathematical realism, and show that none of them reaches its aim. To this end, we will distinguish three aspects of the problem of the applicability of mathematics: the utility of mathematics in science, the unexpected utility of some mathematical theories, and the apparent indispensability of mathematics in our best scientific theories - in particular, in our best scientific explanations. Finally, I argue that none of these aspects constitutes a reason to adopt mathematical realism. (shrink)

La doctrina establecida por la Corte Suprema de Justicia de la Argentina en relación a los crímenes de lesa humanidad cometidos durante la última dictadura militar, expresamente declaraba la obligación del Estado de investigar y juzgar a los responsables de su comisión. La Corte no sólo caracterizó dichos delitos, sino que también estableció que no eran susceptibles de amnistía, indulto, ni prescripción. Pero, en el año 2017 dictó el fallo “Muiña” donde, por voto mayoritario, decidió otorgarle el beneficio del “2 (...) por 1” a un condenado por dichos delitos. La consecuencia fue su inmediata libertad por el vencimiento de la condena. La respuesta de la sociedad fue clara. Con diversas manifestaciones, la sociedad civil, las instituciones y las personalidades públicas se declararon en contra de la sentencia. Más aún, del voto de los mismos jueces se observan expresiones que denotan un gran pesar a la hora de tomar la decisión. Más precisamente, sostenían estar ante un dilema. En este trabajo, lejos de realizar un análisis de la interpretación jurídica que se efectuó en la sentencia, se propone trabajar sobre el concepto de dilema y la posibilidad de aplicación en el presente caso. La finalidad concreta es indagar si se está ante un dilema y en su caso si los jueces utilizan este concepto como un arma argumentativa para lograr adhesión o compasión de la opinión pública. En este sentido, se comenzará relatando el marco jurídico del fallo, donde se describirá la historia judicial de Muiña y los argumentos dados por el voto mayoritario y el minoritario de la Corte. Luego, se realizará un análisis del concepto de dilema, para reconstruirlo sobre la base de dos grandes posturas: Una lógica conceptual y otra fenomenológica. Posteriormente, se realizará un examen de la dimensión institucional del derecho y la moralidad judicial, para - finalmente - poder intentar responder si se está efectivamente ante un dilema. (shrink)
